Administration Lacked Authority Under 2003 Law

In a major setback for President Biden's administration, the Supreme Court has invalidated his massive student loan forgiveness plan. The 6-3 decision, released on Friday, June 30, 2023, ruled that the administration did not have the authority to implement the program under the 2003 HEROES Act.

The HEROES Act, passed in the wake of the 9/11 terrorist attacks, grants the Secretary of Education broad authority to modify student loans in times of national emergency. The Biden administration had argued that the COVID-19 pandemic constituted such an emergency and that the loan forgiveness plan was a necessary measure to alleviate its economic impact on borrowers.

However, the Supreme Court held that the HEROES Act does not authorize the Secretary of Education to cancel student loans on a mass scale. The Court found that the law only allows for targeted loan relief programs, such as those that provide assistance to specific groups of borrowers or those who are experiencing financial hardship.

The decision is a major disappointment for millions of Americans who were hoping to benefit from the loan forgiveness plan. It also raises questions about the Biden administration's ability to address the growing student loan crisis.
